Beavers, deceased, whose place of residence is unknown and whose last known address is unknown, and who cannot be served within the State of Ohio, will take notice that on January 29, 2010, Secretary of Veterans Affairs, filed a Complaint as Plaintiff in the Court of Common Pleas of Montgomery County, Ohio, in Case No. 2010 CV 00768 against Mary J. Beavers, by reason of default under the terms of the Note the unpaid principal balance of $12,987.23 plus interest at the rate of 7.500% per annum from September 1, 2009; that to secure the payment of said Note Defendants, Mary J. REQUEST FOR RELEASE OF FUNDS On or about March 31, 2010 the City of Hamilton, Ohio will submit a request to the U.S. Department of Housing and Urban Development (HUD), Region V Office for release of HOME Investment Partnership Program (HOME) funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended, to undertake the following project: FY 2009-2010 CPS #21 - Habitat for Humanity TriState - new construction of single-family homes, Multi years, Total $195,000.00 ($40,000.00 awarded 5/1/2010 and $155,000.00 amended HOME funds). CPS #32 - Neighborhood Housing Services of Hamilton (NHSH) - new construction of duplex units for rental housing, Multi years, $272,959.79 amended HOME funds. FINDING OF NO SIGNIFICANT IMPACT The City of Hamilton, Ohio has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act (NEPA) of 1969 is not required. Certifies to U.S. Department of Housing and Urban Development (HUD) that Mark Brandenburger, in his official capacity as City Manager, consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's acceptance of the certification satisfies its responsibilities under NEPA and allows the City of Hamilton, Ohio to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept an objection to its approval of the release of funds and acceptance of the certification only if it is on one of the following basis: (a) That the certification was not in fact executed by the Chief Executive Officer or other officer of application approved by HUD; or (b) that applicant's environmental review record for the project indicates omission of a required decision, finding, or step applicable to the project in the environmental review process. Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58), and may be addressed to HUD at 200 North High Street, Columbus, Ohio 43215. Objections to the release of funds on bases other than those stated above will not be considered by HUD. No objection received after April 19, 2010 will be considered by HUD.
