LEGAL NOTICE NO. 2 Electronic bids will be received by the Director of Public Works of the City of Dayton, State of Ohio, until 12:00 Noon, THURSDAY, FEBRUARY 11, 2021 for the following improvement: SALEM AVENUE RECONSTRUCTION PHASE 1 (8% DBE PARTICIPATION GOAL) (FEDERAL STP FUNDS) (STATE ISSUE I FUNDS) Prospective bidders must be on the plan holders list through QuestCDN for bids to be accepted. Bidding documents for this project may be examined online or downloaded at: www.questcdn.com. The QuestCDN eBidDoc Number for this project is: #7477141. There is a non-refundable fee of $50 for each set of bidding documents. Disadvantaged Business Enterprise (DBE) subcontract bidders on this project must be certified with the Ohio Department of Transportation as such. Any bidder seeking information or clarification on Section 35.14 of the City of Dayton's Revised Code of General Ordinances (R.C.G.O.) regarding Equal Employment Opportunity and various rules and regulations of the Human Relations Council regarding the utilization of Disadvantaged Business Enterprise(s) under the Ohio Unified Certification Program should contact the Human Relations Council at 937-333-1403. The City of Dayton follows the Responsive Bidder approach on Federal DBE Projects as provided under 49 CFR Part 26, and reserves the right to evaluate and clarify listed DBE Participation and Good Faith Efforts up to the time of the award of the contract. The Ohio Unified Certification Program encourages all bidders to review the list of certified companies at www.ohioucp.org (click on the "Ohio Unified DBE Directory" button). This Project is being bid with an 8% DBE PARTICIPATION goal. A company must be certified as DBE for the DBE goal at the time of the bid opening and must be pre-qualified to perform the proposed subcontracted work. The participation must be submitted with your bid on the Letter(s) of Intent provided by the City of Dayton Human Relations Council. Letters of Intent must be completely filled out in accordance with the instructions listed on the forms. INFORMATION SUBMITTED AS A MATTER OF BIDDER RESPONSIVENESS: The Owner's award of this contract is conditioned upon Bidder or Offeror satisfying the good faith effort requirements of 49 CFR §26.53. As a condition of bid responsiveness, the Bidder or Offeror must submit the following information with its proposal on the forms provided herein: 1) The names and addresses of Disadvantaged Business Enterprise (DBE) firms that will participate in the contract; 2) A description of the work that each DBE firm will perform; 3) The dollar amount of the participation of each DBE firm listed under (1); 4) A written statement from the Bidder or Offeror that attests their commitment to use the DBE firm(s) listed under (1) to meet the Owner's project goal; and 5) If Bidder or Offeror cannot meet the advertised project DBE goal, evidence of good faith efforts undertaken by the Bidder or Offeror as described in appendix A to 49 CFR part 26. TITLE VI SOLICITATION NOTICE: The City of Dayton, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 USC §§ 2000d to 2000d-4) and the Regulations, hereby notifies all bidders or offerors that it will affirmatively ensure that for any contract entered into pursuant to this advertisement, Disadvantaged Business Enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.
