Notice of Finding of No Significant Impact

NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS The City of Kettering (Kettering) and Montgomery County (County) are responsible entities (RE) for Greater Dayton Premier Management (GDPM) and make environmental review (ER) determinations on proposed GDPM, HUD-funded projects. The following notices shall satisfy two separate but related procedural requirements for activities to be undertaken by GDPM. REQUEST RELEASE OF FUNDS (RROF) On or about March 25, 2019, the RE's will authorize GDPM to submit a request to HUD for the release of Grant funds under Section 9 of the US Housing Act of 1937, as amended, to complete the rehabilitation of 6 residential buildings, located at 514, 520, 526, 532 Telford Ave, along with 1907 and 2018 Shroyer Rd for an estimated amount of $2.4 million using GDPM Capital Funds, along with other federal and state funding. Lead based paint and noise abatement will be conducted as required. FINDING OF NO SIGNIFICANT IMPACT (FONSI) Kettering and Montgomery County have determined that the specified activities will have no significant impact on the human environment. Therefore, an environmental impact statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the environmental review record (ERR) which is available for public examination or copied at the locations and times listed in the first paragraph. Any individual, group, or agency may submit written comments on the ERR to Kettering or Montgomery County as indicated in the first paragraph. All comments received by March 24, 2019 will be considered by Kettering/ Montgomery County prior to authorizing submission of a request for release of funds. Comments should specify which Notice is being addressed. Kettering and Montgomery County certify to HUD that, Kettering City Manager and, Montgomery County Board of County Commissioners consent to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows GDPM to use Program funds. HUD/State will accept objections to its release of fund and the RE's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only on the following bases: (a) the certification was not executed by the Certifying Officer of Kettering or Montgomery County; (b) the RE has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and addressed to the Cleveland Office of PH, Finance & Facilities Management Div., 1350 Euclid Ave, Suite 500, Cleveland, OH 44115.
