Notice of Intent to Demolish a Dangerous Structure

NOTICE OF INTENT TO DEMOLISH A DANGEROUS STRUCTURE The Perry Township (the "Township") Board of Trustees (the "Board") hereby provides notice that, by Township Resolution No. 23:39 ("Res. 23:39") adopted on August 15, 2023, it declared the property situated at 4633 Sulphur Springs Road, Brookville, Ohio 45309 (the "Property"), Parcel ID No. L55 16505 0013, a dangerous property subject to abatement pursuant to Ohio Revised Code ("R.C.") §505.86. The Board hereby provides notice that it intends to demolish and remove the structure(s) situated on the Property to abate the dangerous conditions located thereon. Each owner and lienholder of record (an "Interested Party") is entitled to request a hearing to contest the Board's findings and determination set forth in Res. 23:39. All requests for a hearing must be submitted in writing to the Township Fiscal Officer, Charity Grill, at the Perry Township Offices, 3025 Johnsville Brookville Rd., Brookville, OH 45309, within 20 days from the date this Notice is published. If a hearing is timely requested, a public hearing will be scheduled by separate notice of the Board pursuant to R.C. §505.86, and the Board will issue its final order concerning the Property within 30 days of the hearing. If no hearing is timely requested, the Board will issue its final order (the "Order") concerning the Property within 30 days of this notice, subject to any reasonable delay. Any Interested Party who timely requests and participates in the hearing and is adversely affected by the Board's Order may appeal the Order under R.C. §2506.01. At any time prior to the Township's demolition of the Property, an Interested Party may enter into a written agreement with the Board, to the Board's satisfaction, concerning the abatement of the dangerous conditions at the Property. If the Township proceeds with demolition, the Property owner will be responsible for the total costs incurred by the Township, which costs shall be collected from the Property owner by one of the methods prescribed by R.C. §505.86(F). 9-12/2023
