Notice of Intent to Request Release of Funds

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS May 8, 2019 Ohio Department of Health 246 North High Street Columbus, Ohio 43215 614-728-3105 On or about May 16, 2019 the Ohio Department of Health will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Lead-Based Paint Hazard Reduction Program which is authorized by Sec. 1011 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (Title X of the Housing and Community Development Act of 1992), Public Law 102-550. The Healthy Homes supplemental funding is authorized under Section 502 of the Housing and Urban Development Act of 1970 (12 U.S.C. 1701z-2). Funding was approved and provided by the Consolidated Appropriations Act, 2018 approved March 23, 2018 (Public Law 115-141) for the following multi-year program/project: Ohio Lead Hazard Control Grant Program, for the purpose of performing lead hazard control on 185 properties and 40 properties for the remediation of healthy homes hazards in a 21 county area in the state of Ohio, including the following counties Ashland, Ashtabula, Butler, Clark, Columbiana, Coshocton, Crawford, Geauga, Greene, Guernsey, Lake, Marion, Montgomery, Morgan, Muskingum, Portage, Richland, Stark, Trumbull, Warren and Washington. The agency will implement a comprehensive program to identify and remediate lead-based paint hazards in privately owned rental and/or owner-occupied housing; Healthy Homes Supplemental funds will be used on these same homes if healthy homes hazards are identified following a comprehensive healthy homes assessment. The program wil perform outreach, education and training, identify and remediate lead-based paint and housing-related health and safety hazards and correct hazardous conditions that pose a likelihood of harm to occupant health; conduct sampling and analysis for lead, allergens, carbon monoxide and/or other housing-related health and safety hazards as appropriate; re-evaluate and/or conduct clearance of the remediated activities completed. The interventions will include roof repairs, drainage systems, repair of leaking plumbing and fixtures, repair or installation of ventilation systems (kitchen/bath fans) and HVAC systems, mold remediation, Integrated Pest Management/pest control, repair/replacement of flooring and other slip/trip/fall hazards and lead based paint hazard control through interim control and hazard abatement work. The Ohio Department of Health is requesting the release of funds from HUD in the amount of $3,000,000 for lead hazard control and $600,000 for healthy homes with $330,000 of matched funds for the performance period April 1, 2019 through September 30, 2022 (42 months). The proposed hazard control activities to be funded under this/these program(s) is/are categorically excluded from the National Environmental Policy Act requirements, but subject to compliance with some of the environmental laws and authorities listed at § 58.5 of 24 CFR Part 58. In accordance with §58.15, a tiered review process has been structured, whereby some environmental laws and authorities have been reviewed and studied for the intended target area(s) listed above. Other applicable environmental laws and authorities will be complied with, when individual projects are ripe for review. Specifically, the target area(s) has/have been studied and compliance with the following laws and authorities have been established in this Tier 1 review: Airport Hazards (24 CFR Part 51 Subpart D), Coastal Barrier Resource Act, Clean Air Act, Coastal Zone Management Act, Endangered Species Act, Explosives and Flammable Operations, Farmlands Protection Policy Act, Noise Control Act of 1972, Safe Drinking Water Act of 1974, Wild and Scenic Rivers Act of 1968 and Executive Order 12898 (Environmental Justice). In the Tier 2 review, compliance with the following environmental laws and authorities will take place for proposed projects funded under the program(s) listed above: National Flood Insurance Program requirements, Contamination and Toxic Substances, and Wetlands Protection Act, Historic Preservation, include the list of laws/authorities based on your Written Strategies cited in the Tier I. Should individual aggregate projects exceed the threshold for categorical exclusion detailed at §58.35(a), an Environmental Assessment will be completed and a separate Finding of No Significant Impact and Request for Release of Funds published. An Environmental Review Record (ERR) that documents the environmental determinations for this project, and more fully describes the tiered review process cited above, is on file at the Ohio Department of Health, 246 North High Street, Columbus, Ohio 43215 and may be examined or copied weekdays 8:30 A.M. to 5:00 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Ohio Department of Health, 246 North High Street, Columbus, Ohio 43215. All comments received by May 15, 2019 will be considered by the Ohio Department of Health prior to authorizing submission of a Request for Release of Funds and Environmental Certification to HUD. RELEASE OF FUNDS The Ohio Department of Health certifies to HUD that Amy Acton, M.D., MPH in her official capacity as Director of Health, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Ohio Department of Health to utilize federal funds and implement the Program. OBJECTIONS TO RELEASE OF FUNDS HUD will consider objections to its release of funds and the Ohio Department of Health certification for a period of fifteen days following either the anticipated submission date (cited in first paragraph above) or HUD's actual receipt of the request (whichever is later) only if the objections are on one of the following bases: (a) that the Certification was not executed by the Certifying Officer of the Ohio Department of Health; (b) the Ohio Department of Health has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the Ohio Department of Health has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
