Notice of Intent to Request Release of Funds

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS February 22, 2023 Montgomery County, Ohio Office of Community & Economic Development, 451 W. Third St., 10th floor, Dayton, Ohio 45422, 937-225-4351 On or about March 2, 2023 Montgomery County, Ohio will authorize the Dayton Metropolitan Housing Authority d/b/a Greater Dayton Premier Management (GDPM) to submit a request to the HUD Office of Public & Indian Housing and the HUD Office of Community Planning & Development, for the release of Public Housing Capital Funds under Section 9 of the United States Housing Act of 1937; as amended 42 U.S.C. 1437g and HOME Investments Partnership funds under Title 1 of the Housing and Community Development Act of 1974, Public Law 93-383, as amended 42 U.S.C. 5301 et seq. to undertake a project known as the Imperial RAD Preservation for the purpose of rehabilitating a public housing family development known as Imperial. Imperial is a 12-unit public housing family development located in Vandalia, Ohio. The anticipated project cost is $1.6M. The rehab will include replacement of major building systems, site repairs and apartment unit upgrades. In connection with the rehabilitation, GDPM intends to convert the property from the public housing program to the RAD Project Based Voucher Program in accordance with Rental Assistance Demonstration (RAD) Final Implementation PIH-2019-23 (HA)/H-2019-09, REV-4). At conversion closing, HUD will release the current Declaration of Trust recorded against the property. GDPM anticipates funding the project with appx. $400,000 of HOME Investment Partnership Funds and $1,200,000 of GDPM public housing capital funds. The activities proposed comprise a project for which a Finding of No Significant Impact on the environment was published. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Montgomery County, Ohio Office of Community & Economic Development, 451 W. Third St., 10th floor, Dayton, Ohio 45422 and GDPM's central offices located at 400 Wayne Ave. Dayton, Ohio 45410 where the ERR may be examined or copied weekdays 8A.M to 4:40 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Montgomery County Office of Community and Economic Development. All comments received by March 2, 2023; will be considered by Montgomery County prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION Montgomery County, Ohio certifies to HUD that Erik Collins in his capacity as the Director of Community & Economic Development consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows GDPM to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and Montgomery County's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Montgomery County; (b) Montgomery County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to ClevelandPublicHousing@hud.gov with the subject line reading "objection Project name".
