NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS May 11, 2023, City of Dayton Ohio, 101 West Third Street, P.O. Box 22, Dayton, OH 45402; 937-333-3810; Jordan.Bereda@daytonohio.gov. REQUEST FOR RELEASE OF FUNDS On or about May 19, 2023, the City of Dayton, OH will submit a request to HUD for the release of HOME Investment Partnerships Program (HOME) funds under Title II of the Cranston-Gonzalez National Affordable Housing Act, to undertake a project known as CJ McLin Apartments Acquisition and Renovation. The CJ McLin Apartments is an existing 46-unit apartment project located in Dayton, Ohio. The project is located in the Madden Hill neighborhood. The site addresses are 1414 and 1316 McArthur Ave, Dayton, OH. The estimated project cost is $13,607,239.00. The project will be utilizing $1,157,000.00 in HOME funds. The City of Dayton, Ohio has determined that the activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. Additional project information is contained in the Environmental Review Record (ERR) on file at the Department of Planning, Neighborhoods, and Development, 101 West Third Street, Dayton, Ohio, and may be examined or copied weekdays 8:00 A.M. to 5:00 P.M. The ERR is also available to the public for examination and review either electronically or by U.S. mail. The ERR may be copied and examined online by following this link: https://cpd.hud.gov/cpd-public/ environmental-reviews. PUBLIC COMMENTS Any individual, group, or agency may submit either electronic or written comments on the ERR. Electronic comments may be emailed to Jordan.Bereda@daytonohio.gov. Written comments may be mailed to Jordan Bereda, Department of Planning, Neighborhoods, and Development, 101 W. Third Street, Dayton, Ohio, 45402. All comments received by midnight, May 18, 2023, will be considered by the City of Dayton prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The City of Dayton Ohio certifies to HUD that Shelly Dickstein in her capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Dayton to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the City of Dayton's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Dayton (b) the City of Dayton has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD office by email at this address: CPDColumbusRROF@hud.gov.
