LEGAL NOTICE Board of Zoning Building and Housing Appeals Miamisburg, OH 45342 Notice is hereby given that on Monday, March 11, 2019 at 7:00 p.m., in the Council Chambers in the Civic Center, 10 North First Street, Miamisburg, OH 45342, a public hearing will be held by the Board of Zoning, Building and Housing Appeals for the City of Miamisburg, Ohio on an application, being Case No. BZ-02-19, a request by Michelle Kelly for a temporary use approval to allow for the operation of a retail business out of the ground floor of the structure at 130 N. First Street, Miamisburg, OH 45342. Per code section 1234.03(f), the Board of Building, Zoning and Housing Appeals (BZA) has the authority to "authorize the temporary use of a building or premises in any district for a purpose that does not conform to the regulations prescribed by this Zoning Code for the district in which it is located, provided that such use is of a temporary nature and does not involve the erection of substantial buildings. Such certificate shall be granted in the form of a temporary and renewable permit for not more than a twelve-month period subject to such conditions as will safeguard the public health, safety, convenience and general welfare.
