Notice of Public Hearing the Dayton-Montgomery Port Authority

NOTICE OF PUBLIC HEARING The Dayton-Montgomery Port Authority (the "Authority") will hold a public hearing on behalf of itself and the City of Dayton, Ohio (the "City"), at 3:00 p.m. local time on April 6, 2020, with respect to the issuance by the Authority of its Port Authority Multifamily Housing Revenue Bonds (the Biltmore Towers), in two or more series (including Multifamily Green Tax-Exempt Mortgage Backed Bonds (Green M-TEBS) 2020 Series A and Multifamily Housing Revenue Bonds 2020 Series B) (the "Bonds"), with a maximum aggregate principal amount not to exceed $22,000,000, the proceeds of the sale thereof to be used by the Authority to acquire, renovate, design, develop, equip, furnish, renovate, rehabilitate and improve "port authority facilities" (within the meaning of the Act identified below) to be leased to and operated by Biltmore Preservation, L.P., consisting of a 230-unit multifamily residential rental project for seniors, known as The Biltmore Towers with an address located at 210 North Main Street, Dayton Ohio (the "Project"), located in the City of Dayton, County of Montgomery, Ohio, and to the extent permitted, paying certain costs of issuance, paying capitalized interest and funding debt service reserve funds, if necessary. The Bonds will be issued pursuant to the provisions of Sections 13 and 16 of Article VIII of the Ohio Constitution and Sections 4582.21 through 4582.99 of the Ohio Revised Code (collectively, the "Act"), and pursuant to the Act will not constitute a debt, liability or obligation of the City, the Authority, the State of Ohio or a pledge of the faith and credit of the City, the Authority or the State of Ohio, but shall be payable solely from the funds pledged to the payment thereof. A substantial portion of the Bonds are expected to be issued as "exempt facility bonds" pursuant to Section 142 of the Internal Revenue Code of 1986, as amended (the "Code"). The public hearing will be held in the office of Dinsmore & Shohl LLP, Fifth Third Center, 1 South Main Street, Suite 1300, Dayton, Ohio 45402. Members of the public who do not wish or are unable to attend in person may participate via teleconference by dialing 1-888-830-0426 and using the meeting ID 6144621074, when prompted, to participate. Additionally, the public is invited to attend or to submit written comments to the Executive Director of the Authority at the following address: Dayton-Montgomery Port Authority, 8 North Main Street, Dayton, Ohio 45402 the above address, on or before 3:00 p.m. on April 6, 2020. This public hearing is being held pursuant to the provisions of Section 147 of the Code. This notice supersedes the notice of public hearing for April 2, 2020 published in the Dayton Daily News on March 25, 2020. The public hearing originally scheduled for April 2, 2020, will now be held at the time set forth above. Dated: March 30, 2020.
