Krug and Unknown Spouse, if any, of Claudia Krug, name unknown you will take notice that on May 27, 2022, Plaintiff, filed a Complaint for foreclosure in the Montgomery County Common Pleas Court, 41 North Perry Street, Dayton, OH 45402, being Case No. 2022 CV 02395, alleging that there is due to the Plaintiff on Tax Certificate No. 2019-0000000132, the principal amount of $6,249.40, plus accrued interest of $3,288.74 through June 24, 2022 plus interest at 17.50% thereafter, on Tax Certificate No. 2019-0000000544, the principal amount of $6,468.71, plus accrued interest of $3,202.01 through June 24, 2022 plus interest at 18.00% thereafter, on Tax Certificate No. 2020-00075460, the principal amount of $6,435.16, plus accrued interest of $1,834.03 through June 24, 2022 plus interest at 18.00% thereafter, on Tax Certificate No. 2021-0000000191, the principal amount of $6,363.68, plus accrued interest of $859.11 through June 24, 2022 plus interest at 18.00% thereafter, and the amount paid to the County Treasurer for current taxes, interest, and charges not covered by the Tax Certificates in the principal amount of Taxes, assessments, penalties, interest and charges that are not covered by a tax certificate, Plaintiff is owed as of April 27, 2022, the principal amount of $5,583.75, plus interest at 18% from April 27, 2022, plus additional amounts as may accrue during the pendency of this action as is allowed by Ohio Revised Code Sections 5721.30 through 5721.41 or otherwise, plus attorney fees and additional amounts due which are secured by the Tax Lien Certificates on the real property, which has a street address of 56 East Rahn Road, Dayton, OH 45429, being permanent parcel number N64 03805 0005. Plaintiff further alleges that the Tax Certificate(s) be deemed a valid first statutory lien on the Property pursuant to ORC §5721.10 and §5721.35, and otherwise, for the amount owing, together with Plaintiff's advances for demolition and other costs, the amount owing on subsequent tax certificates acquired by Plaintiff concerning the Property, taxes, assessments, and other charges, costs and attorneys' fees; and by reason of a default in payment by Claudia Krug, Individually and as Executor of the Estate of Dieter W. Krug, for amounts due pursuant to the Tax Lien Certificates; Plaintiff alleges such lien(s) are entitled to be foreclosed, that the Court make findings in accordance with ORC §5721.39 (A) and (B), and that unless the amount found due, including Plaintiff's attorneys' fees and costs relating directly or indirectly to the Tax Certificate(s), be tendered to the Plaintiff prior to the filing of an Entry of Confirmation of Sale in this matter, the equity of redemption of all defendants be foreclosed. Plaintiff prays that the Defendants named above be required to answer and assert any interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said Tax Lien Certificates, marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law. Said Defendant is required to file an Answer on or before the 5th day of September, 2022.
