Legal Notice to the Unknown Spouse, Heirs, Devisees

LEGAL NOTICE To the unknown spouse, heirs, devisees, legatees, assignees, executors, administrators, representatives, guardians of minor and/or incompetent heirs, creditors and estate of John E. Hurley, deceased, and the unknown tenants of John E. Hurley, deceased, ("Defendants"), all of whose present place of residence is unknown, will take notice that on October 2, 2018, the City of Brookville, Ohio ("Plaintiff"), filed its Complaint in Case No. 2018 CV 04527 ("Complaint") in the Common Pleas Court Montgomery County, Ohio involving real property located 692 Vine St., Brookville, Ohio 45309, Parcel Number C05 00101 0045 ("property"). The Complaint alleges that certain accessory structures located on the property are a nuisance under the Property Maintenance Code, Chapter 1353 of the Code of Ordinances of the City of Brookville, and Plaintiff prays for an Order from the Court authorizing Plaintiff to remove these accessory structures from the property to eliminate the nuisance on the property, and authorizing assessment of the costs of abatement of this nuisance, including costs of demolition of the structures, removal of debris, and reasonable attorney fees and court costs incurred in bringing this action, to the Montgomery County Auditor to be placed on the tax duplicate for the subject property to be collected as other real property taxes, and such other relief to which Plaintiff may be entitled in law or equity. All of the above named Defendants are required to answer the Complaint within twenty-eight after the date of last publication which shall be published once a week for six consecutive weeks. In the case of your failure to answer or respond as permitted by the Ohio Civil Rules within the time stated, a judgment by default will be rendered against you for the relief demanded in the Complaint.
