NOTICE OF COMPLAINT FOR AUTHORITY TO SELL REAL ESTATE REGARDING 1214 SUPERIOR AVENUE, DAYTON, OHIO 45402; MONTGOMERY COUNTY AUDITOR'S PARCEL NO. R72 07711 0102; CASE NUMBER 2019 MSC 00186; ELI T. SPERRY V. SARA PHELPS, et al. Stephanie Mann and the unknown persons entitled to the next estate of inheritance from Sara Phelps in the real property who are known to reside in Ohio, whose present addresses and residences are unknown, will hereby take notice that on May 31, 2019, Eli T. Sperry, Guardian of the Estate of Sara Phelps, Plaintiff filed a Complaint in the Montgomery County, Ohio Probate Court, 41 North Perry Street, Second Floor, Dayton, Ohio 45402, being Case No. 2019 MSC 00186 in said Court, against Sara Phelps and others, specifically including all of the above noticed individuals, further praying that said Defendants claiming an interest in the real estate located at 1214 Superior Avenue, Dayton, Ohio 45402, and/or Sara Phelps' assets and/or a right to distribution thereof of therefrom be required to set forth any interest that said Defendants and individuals may have in the real estate, or be forever barred therefrom; that all judicial declarations and determinations in said proceedings be final and conclusive of the rights of all such parties and individuals with regards to the matters above referenced; and that the assets of the referenced Guardianship be distributed in accordance with such declarations and determinations thereafter, as well as for such other and further relief to which the Plaintiffs are or may be entitled. Said Defendants and individuals will take notice that they are required to answer said Complaint within 28 days after the date of the last publication of this notice, said answer date being the 10th day of June, 2020, or Judgment will be rendered as prayed for against any such non-answering Defendant or individual and the interest of said Defendants and individuals in said real estate assets and the distribution thereof and therefrom will be terminated/barred.
