This matter having come to be heard pursuant to Plaintiffs Ex-Parte Motion for Substituted Service, and the Court being fully advised in the premises; NOW THEREFORE IT IS ORDERED AND ADJUDGED that service of process in this action may be made upon the Defendants, EMMANUEL PEREZ and ALEJANDRO TORRES, by mailing a copy of the Complaint, Summons, Demand for Trial and this Order to the Defendant, EMMANUEL PEREZ, at his last known address, to wit: 6888 Yankee Road, Liberty Township, Ohio 45044, and ALEJANDRO TORRES, at his last known address, to wit: 2906 N. Nicholson Road, Fowlerville, MI 48836, by way of regular mail and certified mail, return receipt requested. Proof of Service for these mailings shall be filed with the court by The Sam Bernstein Law Firm.· IT IS FURTHER ORDERED that notice be given by posting, for a period of three weeks, this Order in the Livingston County Circuit Court by Plaintiff who shall file a proof of said posting with the Court. IT IS FURTHER ORDERED THAT this Order shall be published in the: a. By publication of this Court's Ex-parte Order of Substituted Service in the Livingston Daily newspaper, once a week for three consecutive weeks. b. By publication of this Court's Ex-parte Order of Substituted Service in the Butler Eagle, in Butler County Ohio, once a week for three consecutive weeks. Proof of said publications to be filed with the Court by the Sam Bernstein Law Firm. Notice is hereby given: a. That this matter is pending in the Livingston County Circuit Court before the Hon. Michael P. Hatty. b. That the names of the parties to this litigation EMILY GARCIA; MARGARITA FLORES-LOPEZ, EMMANUEL PEREZ, ALEJANDRO TORRES. c. That the nature of these proceedings arise from the careless, reckless, and negligent driving of an ATV by Defendant EMMANUEL PEREZ, on July 4, 2017, causing injuries and damages to Plaintiff EMILY GARCIA, upon or near the property of Defendant, ALEJANDRO TORRES. d. That the Defendants EMMANUEL PEREZ and ALEJANDRO TORRES, having been served by substituted means, as set forth in this Order, must file an Answer or an Appearance within twenty one (21) days of the service upon them with the Clerk of the Livingston County Circuit Court. e. If the Defendants served by substituted means fail to file an Answer or Appearance within twenty one (21) days a default may be entered with the court. A default is a legal document declaring that the facts alleged by Plaintiff in the Complaint are admitted. Defendants may not proceed in the action unless and until the Default is lifted or set aside. After the Entry of a Default the Court, upon the filing of a Motion by Plaintiffs' may assess and award damages for the Plaintiffs and against the Defendants. MICHAEL P.
