To the Defendant: Unknown Heirs, Legatees, and Devisees, if any, of Gregory Root, whose addresses are unknown: In the Montgomery County Clerk of Courts 41 North Perry Street Dayton, OH 45422 Montgomery County, Ohio Court of Common Pleas Plaintiff: Vanderbilt Mortgage and Finance, Inc. Defendants: Unknown Heirs, Legatees, and Devisees, if any, of Gregory Root, et al. Case No. 2020 CV 04398 Judge: E. Gerald Parker Plaintiff has brought this action naming Unknown Heirs, Legatees, and Devisees, if any, of Gregory Root as a Defendant in the above-named court by filing its Complaint on November 17, 2020. The object of the Complaint is to foreclose the mortgage against Defendants. The prayer is that Plaintiff be found to have a good and valid first lien on the within described premises in the amount as set forth in the complaint and accrued interest and penalties, if any; that each of the Defendants be required to answer setting up their interest, if any, in said premises, or be forever barred from asserting same; that unless the amount found due the Plaintiff be paid within a reasonable time to be named by the Court, the equity of redemption of said Defendants shall be foreclosed and an order of sale issued to the Plaintiff for it to be directed to sell said premises as upon execution, and for such other relief as Plaintiff may be entitled. Situated in the City of Dayton, County of Montgomery, State of Ohio: And being Lot Numbered Fifty-Six Thousand Seven Hundred Four (56704) of the Consecutive Numbers of Lots on the Revised Plat of The City of Dayton, Ohio, be the same more or less, but subject to all legal highways. You are required to answer the Complaint within twenty-eight days after the last publication of this notice, which will be published once each week for three successive weeks, and the last publication will be made on December 7, 2020. In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the complaint.
