LEGAL NOTICE NO. 9 Electronic bids will be received by the Director of Public Works of the City of Dayton, State of Ohio, until 12:00 Noon, THURSDAY, FEBRUARY 29, 2024 for the following improvement: 2024 CDBG ASPHALT RESURFACING (25% HUD SECTION 3 WORKER LABOR HOURS & 5% TARGETED WORKER LABOR HOURS) (FEDERAL CDBG FUNDS) Prospective bidders must be on the plan holders list through QuestCDN for bids to be accepted. There is a non-refundable fee of $70 for each set of bidding documents. On November 30, 2020, the U.S. Department of Housing and Urban Development implemented the Section 3 Final Rule which shifted the focus of the provision from new hires for temporary opportunities, to long-term employment and job permanency for low-income workers ("Section 3 workers"). Section 3 is a provision of the Housing and Urban Development Act of 1968 (12 U.S.C. 1701u) that is regulated by the provisions of 24 CFR 75. Section 3 regulations ensure that employment and other economic opportunities generated by certain HUD financial assistance shall, to the greatest extent feasible, and consistent with existing Federal, State and Local laws and regulations, be directed to low- and very low-income persons, particularly those who are recipients of government assistance for housing, and to business concerns which provide economic opportunities to low- and very low-income persons. As required by the Section 3 Final Rule, 25% of all labor hours spent on this project must be performed by a Section 3 worker, and 5% of all labor hours spent on this project must be performed by Targeted Section 3 workers. This information will be reported back to the City on an annual basis. Additional information and definitions pertaining to the Section 3 Final Rule can be found in the bidding documents.
