NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Date of Publication: January 26, 2024 Montgomery County, Ohio 451 W. Third Street P.O. Box 972 Dayton, OH 45422 937-225-5704 To all Interested Agencies, Groups and Individuals: These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Montgomery County, Ohio. REQUEST FOR RELEASE OF FUNDS On or about February 12, 2024, Montgomery County, Ohio will submit a request to the U.S. Department of Housing and Urban Development for the release of Community Development Block Grant (CDBG) program funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following projects: Project Title: Golden Gate Park Inclusive Playground Location: 545 Upper Lewisburg Salem Road, Brookville, OH 45309 Project Description: The inclusive playground design allows children with disabilities to enjoy play equipment alongside other children. Sources of Funds: $425,000 total project cost, $75,000 in CDBG funds Project Title: Lower Carlise Water Main Extension Location: Lower Carlisle Road, Franklin Township, OH 45005 (City of Carlisle) Project Description: Extend a 16" watermain approximately 600' from the termination of the existing water system on Lower Carlisle Rd. to the existing City of Franklin water system. Sources of Funds: $1.9 million total project cost, $75,000 in CDBG funds Project Title: Stubbs Park Swing Set Project Location: 255 W Spring Valley Pike, Centerville, OH 45458 Project Description: The proposed new swing set will include six standard-style swings, one adaptable swing with a belt, and one "Expression Swing". The new accessible rubber matting will replace the existing rubber shavings. Sources of Funds: $6 million total project cost, $40,000 in CDBG funds Project Title: Richardson Park Rehabilitation and Revitalization Location: 283 Liscum Drive, Dayton, OH 45417 (Jefferson Township) Project Description: The proposed project will benefit the low- and moderate-income community is serves, including construction of an ADA-accessible asphalt walking trail and improvements to the existing parking lot. Sources of Funds: $940,013 total project cost, $75,000 in CDBG funds Project Title: Rohrer Park Playground Improvements Location: 720 Rohrer Blvd., Riverside, OH 45404 Project Description: The proposed new toddler play structure is aimed at children ages 2-5 for engaging, low-cost recreation opportunities for low- to moderate-income residents of the City of Riverside and the surrounding community. Sources of Funds: $34,040 total project cost, $10,213 in CDBG funds Project Title: Community Park Playground Improvements Location: 796 Old Harshman Road, Riverside, OH 45431 Project Description: The proposed new toddler play structure is aimed at children ages 2-5 for engaging, low-cost recreation opportunities for low- to moderate-income residents of the City of Riverside and the surrounding community. Sources of Funds: $32,252 total project cost, $9,674 in CDBG funds Project Title: Robinette Park Accessible and Inclusive Playground Location: Enola Court, Vandalia, OH 45377 Project Description: The proposed project will replace two aging playground units and safety surfaces with ADA-accessible equipment designed for ages 2-12 and will be inclusive for children with limited mobility and sensory needs. Sources of Funds: $412,000 total project cost, $50,000 in CDBG funds FINDING OF NO SIGNIFICANT IMPACT Montgomery County, Ohio has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Business Services-Community & Economic Development Office, 451 W. Third Street, Mezzanine, Dayton, OH 45422 and may be examined or copied weekdays 9 A.M to 5 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Montgomery County, Ohio Business Services-Community & Economic Development Office. All comments received before February 10, 2024, will be considered by Montgomery County, Ohio prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION Montgomery County, Ohio certifies to the U. S. Department of Housing and Urban Development that the current President of the Board of County Commissioners consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Montgomery County, Ohio to use Program funds. OBJECTIONS TO RELEASE OF FUNDS The U.S. Department of Housing and Urban Development will accept objections to its release of funds and Montgomery County, Ohio's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Montgomery County, Ohio; (b) Montgomery County, Ohio has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the U.S. Department of Housing and Urban Development, Community Planning and Development, CPDColumbusRROF@ hud.gov.
