Final Issuance of Permit-To-Install and Operate Heider Cleaners Inc, 3720 Wilmington Pike, Kettering, OH 45429 ID #: P0127297, Date of Action: 10/07/2019 Initial Installation General PTIO for Dry to Dry Perchloroethylene dry cleaning machine Rulemaking Date of Action: 10/10/2019 Notice is hereby given that the Director of Environmental Protection, under the authority of Sections 3704.03(E) and 3704.032 of the Ohio Revised Code (ORC) and in accordance with ORC Chapter 119, proposes to file the following rules of the Ohio Administrative Code with the Joint Committee on Agency Rule Review (JCARR): Rule # Title: OAC 3745-25-01 Definitions and reference to materials OAC 3745-25-02 Ambient air quality standards OAC 3745-25-03 Air pollution emergencies and episode criteria OAC 3745-25-04 Air pollution emergency emission control action programs OAC 3745-25-05 Air pollution emergency orders These rules contain Ohio's ambient air quality standards and emergency episode standards which Ohio uses to attain and maintain the national ambient air quality standard (NAAQS) as required under Section 110 of the Clean Air Act (CAA). Ohio EPA has reviewed the rules in this chapter and determine that they remain necessary. OAC rules 3745-25-01 and 3745-25-02 require minor amendments. Pursuant to Section 121.39 of the Ohio Revised Code, DAPC was required to consult with interested parties affected by the rules before the Division formally adopts them. On June 12, 2019, these rules went out for a 30-day review by interested parties. No comments were received. Pursuant to Part D of Title I of the Clean Air Act (CAA), Ohio EPA is required to establish a SIP for the attainment and maintenance of the National Ambient Air Quality Standards (NAAQS). The above-mentioned rules are a part of Ohio's SIP and the proposed amendments will be submitted to USEPA as a modification of the SIP. This hearing will serve as the hearing for the SIP submittal. Pursuant to Section 106.03 and 106.031 of the Ohio Revised Code, a public hearing on these rule changes and SIP revision will be conducted on Tuesday, November 19, 2019 at 10:30 AM at Ohio EPA, Lazarus Government Center, 50 W. Town Street, Suite 700, Columbus, Ohio. All visitors to Ohio EPA must register at the Security desk in the lobby upon arrival. Please bring photo identification (such as a valid driver's license). For security reasons, visitors are required to wear their badge at all times while in the building. Please arrive early to complete these procedures. All interested persons are entitled to attend or be represented at the hearing and give written or oral comments on these rule changes and SIP revision. All oral comments presented at the hearing, and all written statements submitted at the hearing or by the close of business on November 19, 2019 will be considered by Ohio EPA prior to final action on this rule. Written statements submitted after November 19, 2019 may be considered as time and circumstances permit but will not be part of the official record of the hearing.
