NOTICE OF SERVICE VIA PUBLICATION IN THE COURT OF COMMON PLEAS, MONTGOMERY COUNTY, OHIO, CITY OF MORAINE, OHIO AND STATE OF OHIO, ex rel., MARTINA M. DILLON, MORAINE LAW DIRECTOR, Plaintiffs v. EDWARD C. JONES aka EDWARD R. JONES AND EDDIE JONES, AND, IF DECEASED, UNKNOWN HEIRS, NEXT OF KIN, LEGAEES, DEVISEES, ASSIGNEES, EXECUTORS, ADMINISTRATORS AND REPRESENTATIVES OF EDWARD C. JONES, ET AL., Defendants, CASE NO, 2024 CV 00996, JUDGE TIMOTHY N. NOTICE : Unknown Tenants, if any, will take notice that the Plaintiffs, City of Moraine, Ohio and State of Ohio, ex rel., Martina M. Dillon, Moraine Law Director (collectively, "Plaintiffs"), filed their Complaint in the Court of Common Pleas, Montgomery County, Ohio, bearing the above- referenced case number. The object of and demand for relief in the Complaint is for injunctive relief to enjoin Defendant Edward C. Jones ("Defendant Jones") and others from occupying and using the subject property, more commonly known as 4617 Miami Shores Drive, Moraine, Ohio 45439, in violation of Moraine Codified Ordinances and the Ohio Revised Code; for an Order declaring the Property at 4617 Miami Shores Drive, Moraine, Ohio 45349 a public nuisance; and for an Order of Abatement, ordering Defendant Jones to take immediate action more particularly described in the Prayer Section Ca.-Cc of the Complaint to abate the nuisance; and if Defendant Jones fails to comply with the Court's Order of Abatement within thirty (30) days of issuance, Plaintiffs, et al., are authorized to enter onto the Property for the purpose of demolition of the structure/building on subject Property and associated clean-up on the subject Property. Unknown Tenants, Defendants, are required to answer the Complaint within twenty-eight (28) days after the last publication of legal notice.
